Our Terms and Conditions

As used in these general terms and conditions, the following terms shall have the following meanings:
- “we, us, ours, company” shall mean our matchmaking company, AE Matchmaker.
- “you, yours, client, applicant, candidate” shall mean any party who has requested our services.
- “T&C’s” shall mean these Terms and Conditions
- “Agreement” shall mean a separate agreement concluded between you and us to lay down both parties’ rights and obligations, payment terms, and other specific terms in connection with the provision of our services.

You hereby represent and confirm that you are at least 18 years old, single (either never married, divorced, widowed or separated), are of a sane mind and have never committed/do not intend to commit any criminal offences and/or violations.

You hereby agree that we may share the information you provided for the specific purpose of connecting you with potential dates, which includes sharing your personal profiles, photos, and contact details with those individuals.
Please note that we will provide the personal information of any applicant to other interested applicants only if we have received your written consent (incl., by email).
You also understand and agree that we may disclose your personal information or data to the extent necessary to observe laws, court orders, or any governmental regulations, or if we believe in good faith that disclosure is necessary to protect our rights or property, or to respond in emergency situations to ensure the safety of others. We will make sure to notify you in advance of any such disclosure (if prior notice is not practicable, then immediately after such disclosure).

You agree to immediately provide us with any changes in your profile, such as changes in your personal status, address, telephone number, email-address, and marital status (including living with someone or dating someone exclusively). Any changes must be sent to us immediately in writing (incl. by e-mail), within a maximum time of five working days.

The registration/application form shall be filled by the applicant. Any information excluded shall not be considered for matchmaking. We do not carry out any investigation and background checks on individual profiles. It is the sole responsibility of every individual opting to use our services to provide true and factual information about themselves and their background.

Providing false information is unethical and illegal and may attract legal action against the individual furnishing incorrect information. All benefits under these T&C’s and the Agreement should be withheld/suspended for an individual providing false information.

Hence, we shall not be held responsible for any veiled, inaccurate, incomplete or false information provided by any individual for unethical purpose or intent.

You understand that we carry no liability and make no representations or warranties, either express or implied, as to the accuracy, completeness or authenticity of the information provided by our clients. We make no representations as to the fitness of any individual for any purpose whatsoever.

Because we make no representations whatsoever regarding any individual, you understand that you must make every effort to satisfy yourself that the individual with whom you plan or agree to interact with is safe, trustworthy and acceptable to you.

You hereby expressly, voluntarily, and knowingly agree to fully and completely assume the risk of interacting with any individual(s) with whom you come in contact either directly or indirectly by using our services.

You understand that while we will make every effort to find a suitable match for you (by means of an in-depth interview with each applicant and analysis of their psychological profile and personal information), we do not guarantee results. There is no express or implied warranty that a spouse or life partner can or will be found. You therefore agree that we cannot be held responsible (i) for any failure to find a match that is perfectly compatible with you, (ii) if you decide to separate with the match we found, (iii) if you are not fully satisfied with the match we found or (iv) if you provide us incomplete, false or inaccurate information that has led to unsatisfying matching results.
As a result thereof, you understand that the Agreement may be terminated at any time by either party and that there will be no refunds of any fee(s) whatsoever.

We shall not to be held responsible for any issues whatsoever that arise after successful conclusion
of our matchmaking process and related services. We are only responsible for providing compatible profiles using our experience and skills. We only encourage both the parties to conclude a match after the positive consent and agreement between both the parties.

Moreover, we are under no obligation to find any definite or indefinite number of matches for an individual candidate if there aren’t any matching the criteria. Finding a match entirely depends upon the compatibility of profiles with each other.

We are under no obligation to accept all registration requests/applications and can reject any if their profile is sought unfit or impose danger for the interests of our company and our clients/other applicants.
We reserve the right to terminate the membership/Agreement should the above reasons come into light after concluding the Agreement.

You agree to fully and completely indemnify and hold harmless our company, our principals, owners, officers, directors, employees, heirs, successors and assigns, from any and all damages, expenses, costs (including, but not limited to costs of defence, attorneys fees and costs of court), claims, causes of action, suits, demands and liabilities of whatever nature whatsoever, including, but not limited to damages for personal injuries and emotional distress that arise either directly or indirectly as the result of any service(s) provided by, any action or failure to act on the part of our company, whether during the term of the Agreement concluded with you or at any time thereafter.

The foregoing extends to any claim(s) for the improper or negligent dissemination of private, unauthorized or inaccurate information regarding your profile, that it placed you in a false light, or that you relied to your detriment on any information, opinion, or advice provided by us.

These T&C’s shall be governed as to all matters, including, but not limited to, validity, construction and performance, by and interpreted in accordance with the laws of the Austrian Republic.

If you have a dispute with one or more of the individuals with whom you get in contact with either directly or indirectly by using our services, you release us from any of the above listed damages, claims, liabilities or causes of action.

All disputes, controversies or differences arising out of or in connection with these T&C’s and the Agreement, except a dispute alleging criminal violations, shall be settled first by mutual negotiations. If the negotiations did not lead to the mutually satisfying outcome, such disputes, controversies or differences shall be settled by arbitration before a mutually acceptable neutral arbitrator.

The ruling of the arbitrator shall be final, binding upon the parties and enforceable as a final judgment pursuant to the laws of the Austrian Republic based on VIAC Rules. The place of arbitration shall be Vienna, Austrian Republic. In the event of a dispute, the prevailing party shall be entitled to reasonable attorneys’ fees and costs.

The company reserves the right to amend its T&C’s whenever it deems right.

In the event that any clause or provision of T&C’s shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of these T&C’s which shall continue to be enforceable upon both parties.

Further, T&C’s inure to and are binding on your heirs, administrators, executors and representatives.

These T&C’s contain the entire understanding between you and us and no oral representations by either party shall in any way affect or deviate from these T&C’s. You represent that you are not acting in reliance upon any agreements, promises or representations not expressly set forth herein.
